1. Definition of Service

waveplays agrees to provide the buyer with Dolby Atmos mixing services, where raw audio tracks provided by the buyer will be enhanced, mixed, and formatted to meet Dolby Atmos specifications.

2. Payment Terms and Refund Policy

Payment is due upfront utilizing the waveplays store. If the buyer is not satisfied with the service provided, they must notify waveplays within 7 days of receiving the first version of the mix. Upon mutual agreement, either one revision will be provided at no additional cost or a full refund will be issued.

3. Intellectual Property Rights

Upon payment, the mixed audio remains the intellectual property of the buyer. waveplays retains no rights to the mixed audio but retains the right to use the work as part of its portfolio or for promotional purposes unless explicitly restricted by the buyer.

4. Confidentiality

All materials provided by the buyer, including raw audio tracks and any associated files, will be treated as confidential. waveplays commits to not disclosing, sharing, or using these materials for any purpose other than the provision of the mixing service.

5. Limitations of Liability and Warranty Disclaimers

waveplays will provide its services using a reasonable degree of skill and care. However, waveplays disclaims any warranties, express or implied, regarding the service's fitness for a particular purpose. Liability for any damages arising from the service is limited to the amount paid by the buyer.

6. Termination Clauses

Either party may terminate this agreement with 30 days written notice. In the event of termination, any payments made for work not yet delivered will be refunded to the buyer.

7. Governing Law and Dispute Resolution

This agreement is governed by the laws of Amtsgericht Charlottenburg, Amtsgerichtsplatz 1, 14057 Berlin. Any disputes arising from this agreement will first attempt to be resolved amicably through mediation. If unsuccessful, disputes will be settled in the competent courts of Amtsgericht Charlottenburg, Amtsgerichtsplatz 1, 14057 Berlin.
